What is an Expert Witness?

An expert witness provides independent, professional evidence to support legal or planning cases where specialist technical knowledge is required. In the context of land development, and environmental planning, this often includes interpreting complex information about soils, land classification, agricultural use, and site suitability. Any of these may have been cited as reasons for refusal of a planning application.

Expert witness involvement may be required when:

A planning application is refused
Enforcement action is taken by a local authority
A dispute arises involving land use, access, or development impact
A case progresses to appeal, inquiry, or court proceedings

The role of the expert witness is to offer impartial, evidence-based insight that assists decision-makers in understanding the technical aspects of a case. This may involve preparing written evidence, attending hearings, and being cross-examined in public forums.
